TERMS OF SERVICE

OVERVIEW​

This website is operated by The Table Home Company, LLC , a Texas limited liability company. Throughout the site, the terms “we”, “us” and “our” refer to The Table Home Company.  These Terms of Use (the “Terms”) describe the terms and conditions that apply to your use of this website, mobile applications, and social media channels, as well as the purchase of The Table Home Company DIY Plans (“Plans”) and Design Services (“Services”).  The Table Home Company’s offer of its Plans and Services on this site is made available to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here, including those additional terms and conditions and policies referenced herein and/or available by hyperlink.  By accessing, using or interacting with the Services in any way, whether as a browser, vendor, customer, merchant and/or contributor of content, you agree to be bound by these Terms.

If you do not agree to all the terms and conditions of this agreement, then you may not purchase any Plans or use any Services.  If these Terms are considered an offer, acceptance is expressly limited to these Terms.  Any new features or tools which are added to the current store shall also be subject to the Terms.  You can review the most current version of the Terms at any time on this page.  We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our site.  It is your responsibility to check this page periodically for changes.  Your continued use of or access to the site following the posting of any changes constitutes acceptance of those changes.

We recommend you review these Terms each time you purchase a plan or use the Services and that you print a copy of these Terms for your future reference.

Our website is hosted on Wix.com LTD (“Wix”).  They provide us with the blog online e-commerce platform that allows us to sell our Plans and Services to you.

​

DESIGN SERVICES

Based on existing plans or measurements to be taken or confirmed by the client, The Table Home Company, LLC will, as and where we deem it appropriate, perform the following services:

​

  • Conduct an initial virtual design consult of the exiting conditions and/or vision of the space as necessary.

  • Discuss with you, your design preferences for each of the Project Areas.

  • Prepare schematic plans for recommended spaces and decorative details including but not limited to, a concept board and/or floor plan.

  • Prepare suggested layout plans specifying the general location for and the distribution of movable furniture and furnishings.

  • Our Design Documents that are prepared in this phase of the Project will illustrate our suggested design concepts and will be presented to you for your review and written approval.

  • The preparation of 3D designs, digital drawings, elevations, renderings, or other detailed drawings for custom millwork, cabinetry, or furnishings are not included as a design service under this Agreement.

  • Specific room styling accessories that would be placed on a tabletop or bookshelf are not included under this agreement unless otherwise agreed upon.

SELECTION OF MERCHANDISE

The Table Home Company, LLC will, as and where we deem it appropriate, perform the following services:

  • Select and source Merchandise for your Project via retailers and online stores.

  • Provide fabric samples, finish samples, photographs, or other visual illustrations of Merchandise for your consideration.

  • Provide a custom shopping list with product specifications for your approval and purchasing of merchandise.

  • Installation: You will be responsible for receiving and installing all products purchased via the shopping list provided.

The Table Home Company, LLC is not responsible for the quality of the products that are recommended. The Table Home Company, LLC aims to choose the best quality of products within your budget. If you have an issue with any of the products or merchandise, you will need to work directly with the supplier.

​

PURCHASING SERVICES

Each item of Merchandise and Decorative Installations to be purchased & ordered by you will be specified in a Shopping List prepared by us and submitted in each instance for your approval. Each shopping list will describe the item or service to be purchased and its “Specified Price” to you.

​

PRODUCT PRICING AND ORDERING

The “Specified Price” of each item of Merchandise and Decorative Installations shall be the retail cost for the item or service.

All links to shop the products will be available for purchase using the links provided in the product list. Many of our posts and products contain affiliate links. If you click on an affiliate link and buy something, The Table Home Company, LLC may receive a very small commission. It does NOT result in additional charges to you or cost you anything extra.

ORDERING & PAYMENTS

For our E-Design Packages, you will be responsible for (a) managing your orders and following up with vendors regarding any delays or errors in processing your orders; and (b) scheduling and coordinating deliveries with vendors to your residence.

​

PROJECT ADMINISTRATION SERVICES

The Table Home Company, LLC is not responsible for any project management, administration, or timelines associated with your project.

​

DESIGNER COMPENSATION

​

FULL ROOM E-DESIGN

Paid In Full Upon Receipt of Invoice. Services will not be performed until payment is received.

​

Included in the package:

  • 30 Minute Phone Consultation

  • Selection of furniture, décor, lighting, ready-made curtains/shades, and paint color recommendations, wall coverings or accent walls as needed for the space and where to buy them

  • 1 round of revisions – additional revisions will be charged at an hourly rate

  • Design Board

  • Floor Plan

  • Shopping List (Retail Only)

  • Designer How-To and Styling Guide with Notes

​

Not Included in the package:

  • Specific room styling accessories (e.g. bookshelf and tabletop decor)

  • Selection or design of custom furniture, window treatments, or built-ins

  • 3D Rendering of the room

 

FINISHES & FIXTURES E-DESIGN

Paid In Full Upon Receipt of Invoice. Services will not be performed until payment is received.

Included in the package:

  • 30 Minute Phone Consultation

  • Selection of finishes (tile, hardware, cabinets, countertops, and paints), fixtures (lighting and plumbing fixtures), and fittings (mirrors, accessories, and shelving) and where to buy them

  • 1 round of revisions – additional revisions will be charged at an hourly rate

  • Design Board

  • Shopping List (Retail Only)

  • Designer How-To and Styling Guide with Notes

Not Included in the package:

  • Specific room styling accessories (e.g. bookshelf and tabletop decor)

  • Floor Plan

  • Selection or design of custom furniture, window treatments, or built-ins

  • 3D Rendering of the room

 

SPACE PLANNING E-DESIGN

Paid In Full Upon Receipt of Invoice. Services will not be performed until payment is received.

Included in the package:

  • 30 Minute Phone Consultation

  • 1 round of revisions – additional revisions will be charged at an hourly rate

  • Floor plan

  • Designer How-To Guide with Note

​

Not included in the package:

  • Design board

  • Shopping list

  • Selection of finishes or merchandise and where to buy them

  • 3D Rendering of the room

 

EXTERIOR RENDERING

Paid In Full Upon Receipt of Invoice. Services will not be performed until payment is received.

 

Included in the package:

  • 30 Minute Phone Consultation

  • 1 exterior photo rendering

  • Selection of exterior finishes and where to buy them

  • 1 round of revisions for the following items: door style/color, garage door style/color, lighting,  shutter style/color, paint color, trim color, roof color, address numbers, and/or planters. Additional revisions or revisions outside of this list will be charged at an hourly rate.

  • Generic landscaping to go with the house exterior.

Not included in the package

  • Landscaping options that are specific to your area. We only use generic landscape options.

  • The free revision round does not include: stairs, walkways, railings, roofline or gable changes, windows, landscape, hardscape (driveway or walkway), roof style or material, cladding changes such as: stone to brick/ brick to stone, that includes siding, changing stone to different color or style, paint to limewash or German Smear, siding direction from horizontal to vertical/ vertical to horizontal, etc.

DESIGNER ON CALL

Paid in full upon receipt of invoice. Payment is due at the time that you schedule your designer on call session online.

Included in this service:

  • Mood board development

  • Furniture and décor selection

  • Finish, fixtures, and fittings selection

  • Renovation and design plan review

  • Work with contractor on design questions

  • Wall décor and styling ideas

​

Not included:

  • Design boards

  • Floor plans

  • 3D designs

​

HOURLY DESIGN FEE FOR CUSTOM DESIGN SERVICES AND/OR ADDITIONAL REVISION TIME:

  • Initial Hour/Consultation: $120

  • Hourly Fee after initial hour/consultation: $95

TERMS & CONDITIONS OF SALE

PRICING

Prices are subject to change. Prices will not change for a specific client project for an already agreed upon service.

​

AVAILABILITY AND DELIVERY OF PLANS AND SERVICES

All Plans and Services featured on our site are subject to availability.  We reserve the right to change or remove a Plan Or Service or other content on the site at any time without notice or liability to you or to any third party. 

​

We reserve the right, but are not obligated, to limit the sales of our Plans or Services to any person, geographic region or jurisdiction or to reject any order we receive.  We may exercise this right on a case-by-case basis.  We reserve the right to limit the quantities of any Plans or Services that we offer.  All descriptions of Plans, Services, or product pricing are subject to change at any time without notice, in our sole discretion.  We reserve the right to discontinue any Plan, Service, or product offering at any time.  Any offer for any product or service made on this site is void where prohibited.

CANCELLATIONS OR REFUNDS

The Table Home Company, LLC does not offer cancellations or refunds. Once the service or package is purchased, we begin working on the design, so The Table Home Company, LLC cannot provide a cancellation or refund.

​

OPTIONAL TOOLS

In connection with our provision of the Services, we may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

​

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement.  We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources).  Such new features and/or services shall also be subject to these Terms.

​

FAILURE TO MAKE PAYMENTS WHEN DUE

The Table Home Company, LLC will not release design documents until full payment is received. A $50 late fee will be applied to every 30 days past the due date of the invoice.

​

DELIVERY OF PACKAGE OR SERVICE

Initial design draft will be delivered 7 business days after the design questionnaire is received and the initial consultation has taken place (if applicable) is received. The design questionnaire will be sent to you upon purchase of the package. You must fill out the design questionnaire to schedule a design consultation. The Table Home Company, LLC will not start designing until the design questionnaire is received and the design consultation has taken place. If you choose to not have a design consultation, The Table Home Company, LLC will begin designing once the questionnaire has been received.

QUALITY OF PRODUCTS

The Table Home Company, LLC are not responsible for the quality of products we recommend in our designs. The Table Home Company, LLC will choose the best quality products with the budget given. If you have any issues with the product quality, you need to address those with the supplier or vendor.

​

DESIGN DOCUMENTS

All design documents are conceptual in nature and are not guaranteed to be subject to code or regulations in your specific area. These documents should not be used for anything other than home design purposes.

​

USE OF DESIGN RELATED PROFESSIONALS AND THIRD PARTIES

Should the nature of our Design Documents require the services of third-party professionals, consultants, or contractors (“Design Related Professionals”) or other third parties to perform work based upon our Design Documents, you agree to enter into separate agreements directly with each of them, under terms that are mutually acceptable to you both. To the extent that we may review any construction documents (or other documents) prepared by them or by any other person, please know that our review is for the sole and limited purpose of achieving general compliance with our aesthetic concepts and overall design intent.

YOUR RESPONSIBILITIES TO US

You must provide us with a completed design questionnaire complete with dimensions of the room. If you are purchasing an exterior rendering, The Table Home Company, LLC must have a high-resolution photo.

​

INDEPENDENT PURCHASES

All products will be purchased independently by the client for their space. The Table Home Company, LLC are not responsible for incorrect purchases, defected items, or items that do not fit the measurements given. All links to shop the products will be available for purchase using the links provided in the product list. Many of our posts and products contain affiliate links. If you click on an affiliate link and buy something, The Table Home Company, LLC may receive a very small commission. It does NOT result in additional charges to you or cost you anything extra.

OWNERSHIP AND USE OF DOCUMENTS

The Table Home Company, LLC owns all designs and documents provided to the client. The Table Home Company, LLC continues to own the designs and documents after the design service is performed. These documents could be used on, but not limited to, website images, social media content and posts, and promotional and marketing material. The Table Home Company, LLC reserves the right to use these documents how we choose.

​

VIOLATION OF THESE TERMS OF USE

If you are in breach of, or we suspect you are in breach of, these Terms, then we may take any/all of the following actions:

  • issue a warning to you;

  • immediate, temporary or permanent withdrawal of your access to your account and/or the site; however, you will remain responsible for any outstanding payments to us for Digital Prints;

  • legal action against you;

  • disclosure of information to law enforcement authorities as we reasonably feel is necessary.

​

The responses described above are not limited and we may take any action we reasonably deem appropriate.

​

EVENTS OUTSIDE OUR CONTROL

We will not be liable or responsible for any delay or failure to perform any of our obligations under these Terms that is caused by events outside our reasonable control (a “Force Majeure Event”), including, but not limited to, acts of God, strikes, lock outs, accidents, war, fire, the act or omission of government, highway authorities or any telecommunications carrier, operator or administration or other competent authority, the act or omission of any Internet Service Provider, or the delay or failure in manufacture, production, or supply by third parties of equipment or services.

Our performance under these Terms will be suspended for the period that the Force Majeure Event continues, and we will be entitled to a reasonable extension of time for the performance of our obligations under these Terms after notifying you of the nature of extent of such Event.  We will use commercially reasonable efforts to bring the Force Majeure Event to a close or to find a solution by which our obligations relating to the Digital Prints may be performed despite the Force Majeure Event.

INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold us harmless from and against any and all third-party claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees and related costs) (each a “Claim”, and together “Claims”) relating to, arising out of or resulting from the actions and omissions of you and/or of any Design Related Professional, construction contractor, contractor, subcontractor, vendor, tradesperson, supplier, agent, or other third party hired or otherwise retained by you or on your behalf.

​

LIMITATION OF LIABILITY 

To the fullest extent permitted by law, our total liability to you in regard to any and all claims, losses, and damages arising out of, relating to or resulting from this Agreement or the services performed by us pursuant to this Agreement, shall not for any reason exceed the greater of (i) the total amount of Design Fees and other Designer compensation actually paid to us pursuant to this Agreement; or (ii) the available proceeds of our insurance policies, if any, and if applicable. Under no circumstances shall The Table Home Company, LLC be responsible for (a) any indirect or consequential damages; or (b) any injury, loss, damage or delay caused by any reason beyond our reasonable control. Also, The Table Home Company, LLC is not responsible for the actions or omissions of any Design Related Professional, construction contractor, contractor, subcontractor, vendor, tradesperson, supplier, agent, or other third party, even if The Table Home Company, LLC recommends them to you. Additional limitations of liability regarding the sale of Merchandise to you is set forth in the “Terms and Conditions of Sale” section in this agreement. No action against us for breach of this Agreement or otherwise may be brought more than one (1) year after the date of the accrual of such cause of action.

GOVERNING LAW

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Texas.
